By accessing or using Arbitrage Agent ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
The Service is an arbitrage detection and signals platform: it identifies price discrepancies between prediction markets and provides alerts and step-by-step guides. You place all trades yourself, directly on Kalshi and Polymarket, under your own accounts and their respective terms. An automated execution feature is in testing; when it launches, additional terms specific to automated execution will apply before you can enable it.
Arbitrage Agent is a software tool, not a licensed financial advisor, broker, or investment manager, and it is not authorised by the CMVM, the FCA, the SEC, the CFTC or any other financial regulator. Nothing on this platform constitutes financial, investment, legal, or tax advice. All information, signals, and P&L figures are provided for informational purposes only. You are solely responsible for your trading decisions.
Nothing we send you is a personal recommendation. The Service applies the same arithmetic to public market data for every subscriber and shows every subscriber the same detected price discrepancies. We do not know, ask about, or take into account your financial situation, your investment objectives, your knowledge and experience, your tax position, or your risk tolerance, and we do not assess whether any trade is suitable or appropriate for you. Where the Service displays a position size, that is a generic calculation performed on a bankroll figure you typed in yourself — it is arithmetic applied to your own input, not a recommendation that you should trade that amount, or trade at all.
Performance figures, P&L statistics, win rates, and trade counts displayed on the landing page and in demos are simulated or illustrative. They do not represent actual trading results and are not a guarantee of future performance.
Figures we describe as "dry-run", "paper", "simulated" or "test" are not real-money trading results. They are produced by a simulator that assumes both legs fill immediately, in full, at the quoted price, with no slippage, no partial fills, no queue position and no rejected orders. Real execution will differ, and the difference is not necessarily small. Where we publish live operational metrics — such as opportunities detected, spreads observed, or uptime — those describe what our software measured, not what any person earned. No figure anywhere on this site is a forecast, a projection, or a promise of any return.
Trading on prediction markets involves substantial risk of loss. You may lose some or all of your capital. Do not trade with money you cannot afford to lose. Arbitrage Agent makes no warranty that the agent will be profitable or that arbitrage opportunities will exist at any given time.
You need accounts on both Kalshi and Polymarket. Every signal we send requires one order on each venue; there is no version of this strategy that works with only one. Both venues restrict access by country and change those restrictions without notice — Kalshi's Member Agreement names more than fifty restricted jurisdictions, and Polymarket is geo-blocked in a number of countries, several of them in the EU.
Checking that you can open and use both accounts is your responsibility, before you subscribe. We sell this Service to subscribers in every country and we do not verify your eligibility on either venue. We are not responsible, and do not offer refunds, if you are unable to register with, deposit to, access, or trade on either venue for any reason — including geo-blocking, account rejection, identity verification, payment methods, or a change in either venue's terms or in your local law after you subscribe. Anything we publish about which countries each venue accepts is general information, not legal advice, is not exhaustive, and may be out of date.
You remain solely responsible for ensuring that your use of this Service, and any trading you do, complies with the laws of your jurisdiction and with the current terms of both venues. By using the Service, you represent that you are legally permitted to do so. Nothing here is investment advice, and we do not accept, hold, or transmit your funds — your capital stays on your own Kalshi and Polymarket accounts at all times.
The signals Service requires no API keys. If and when you choose to connect exchange API keys (an optional feature used by the upcoming automated execution), the Service uses a Bring Your Own Keys (BYOK) model: you provide your own keys, which are encrypted at rest using AES-256-GCM. While we take reasonable security measures, we cannot guarantee absolute security. You are responsible for the security of your credentials and should revoke any keys immediately if you suspect compromise. Arbitrage Agent is not liable for any losses arising from compromised credentials.
To the maximum extent permitted by law, Arbitrage Agent and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: trading losses, loss of profits, loss of data, or service interruptions. The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims arising out of or relating to the Service is limited to the total amount you actually paid us in the twelve months immediately before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited — including, if you are a consumer, your mandatory rights under the consumer protection law of your country of residence.
You agree to indemnify and hold harmless Arbitrage Agent and its operators from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your trading activity, your breach of these Terms, or your breach of either venue's terms or of any law applicable to you.
Your subscription is personal to you. You may not resell, republish, redistribute, forward, syndicate, or otherwise share the signals, alerts, or data you receive, whether for payment or free, and you may not scrape the Service or use it to build or train a competing product. We may suspend or terminate any account that does so, or that we reasonably believe is being used unlawfully or abusively, and we may do so without notice and without refund.
We do not guarantee uninterrupted availability of the Service. Downtime, bugs, third-party outages (email, Telegram), or exchange API changes may delay or prevent the delivery of signals and alerts — and, when automated execution launches, the execution of trades. Opportunities are time-sensitive and may no longer be available by the time you act on an alert. We are not liable for missed opportunities or losses due to service unavailability or alert latency.
Subscriptions are billed monthly, annually, or as a one-time lifetime payment, as selected at checkout. Recurring subscriptions renew automatically until you cancel. You may cancel at any time and keep access until the end of the period you have paid for; cancelling stops the next renewal.
All payments are final. We do not issue refunds — not for partial billing periods, not for unused access, not for opportunities you did not act on or did not find profitable, and not if you are unable to use either venue. Where the law of your country gives you a right that cannot be contracted away, that right is unaffected by this paragraph; nothing else is.
Your capital remains on the exchanges at all times — we never custody your funds.
These Terms are governed by the law of Cyprus, and the courts of Cyprus have jurisdiction over any dispute — except that, if you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings there. Nothing here deprives you of that right. Before starting proceedings, please email us: most things are faster to fix directly.
We may update these Terms. For changes that materially affect your rights or obligations we will give notice by email, or in the app, before they take effect. Continued use of the Service after that constitutes acceptance; if you do not accept, you may cancel, and the cancellation takes effect at the end of the period you have already paid for.
